4. Payment Terms

4.1 Fees

All fees are stated in US Dollars (USD) and are exclusive of applicable taxes unless otherwise specified. You are responsible for paying all applicable taxes.

4.3 Billing Cycle

Subscriptions are billed in advance on a monthly, quarterly, semi-annual, or annual basis, depending on your chosen plan. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

4.4 Price Changes

We reserve the right to change our pricing at any time. Price changes will be communicated to you in advance and will apply to subsequent billing cycles after the notice period.

4.5 Failed Payments

If a payment fails, we may suspend or terminate your access to the Service until the outstanding balance is paid. We are not responsible for any interruption in Service due to failed payments.

5. Refund Policy

We offer a 7-day money-back guarantee on all new subscriptions. If you are not satisfied with our Service, you may request a refund within 7 days of your initial purchase. Refunds are not available for renewal payments or after the 7-day period has expired.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund and may subject you to legal action.

9. Service Availability & Modifications

We strive to provide uninterrupted Service, but we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, or technical issues beyond our control.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9.3 Channel Lineup Changes

Channel lineups and VOD libraries are subject to change without notice due to licensing agreements, provider changes, or other factors beyond our control.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy, reliability, or quality of any content.
• Warranties that defects will be corrected or that the Service is free of viruses.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUESTREAM IPTV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless BlueStream IPTV and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

13. Termination

13.1 Termination by You

You may cancel your subscription at any time by contacting our support team. Cancellation will take effect at the end of your current billing cycle. No refunds will be provided for partial billing periods.

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our Acceptable Use Policy.
• We suspect fraudulent or illegal activity.
• Your payment method is declined or reversed.
• We are required to do so by law.

Upon termination, your right to access the Service will immediately cease. We shall not be liable for any damages resulting from termination.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Austin, Texas.

We reserve the right to update or modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
